Three-Year Limited Warranty (the “Hamilton Guarantee”)

Effective Date: September 1, 2025

1) Warranty Scope 

Hamilton Motor Company (hereinafter “Hamilton,” “we,” “us,” or “our”) is a U.S.-based company, and, while we are happy to accommodate deliveries to certain international destinations, warranties to any products delivered outside of the United States are subject to certain additional limitations set forth in Section 10, below.  Our warranty only covers products purchased directly from us on our website or on your behalf by Hamilton authorized installers.  Our website domain is www.hamiltonmotorcompany.com, and we do not sell our products at any other stores or websites.  A full list of authorized installers is available at www.hamiltonmotorcompany.com/pages/find-an-installer.  We do not have any other authorized resellers, and the warranty does not cover any products purchased from any other third parties.

This warranty covers customers (“you” or “your”) who purchase any Hamilton products on or after the Effective Date, including our kits for Apple CarPlay or Android Auto, our retrofit electronics for Mercedes and any other Hamilton parts and accessories.  EXCEPT FOR THE WARRANTIES EXPRESSLY SET FORTH HEREIN, YOU DISCLAIM ALL OTHER WARRANTIES, EXPRESS AND IMPLIED, WITH RESPECT TO OUR PRODUCTS, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

2) Warranty Coverage & Period 

Hamilton warrants to the original purchaser that our products will be free from defects in materials, workmanship and manufacturing under normal use for three years from the date of purchase (the “Warranty Period”). 

This is a limited warranty—not an insurance policy or a three-year return policy.  Hamilton’s coverage for materials, workmanship and manufacturing defects does not include coverage for any design defects. 

In other words, we do not provide warranty coverage for features or characteristics of Hamilton products that are functioning as originally designed.  This includes the choice of components or materials selected by our product designs.  If you are dissatisfied with the design or features of our products, we encourage you to consider whether you would be eligible for a return.  Returns are governed by our separate Return Policy, available at https://www.hamiltonmotorcompany.com/pages/support.   

Likewise, as discussed further in Section 4E below, we are not responsible for any damage that is not a result of the materials, workmanship or manufacturing of the product (e.g., intentional or unintentional damage by the customer).

3) Remedies Under Warranty

If a product fails during the Warranty Period, we will, at our option:

(a)   repair the defective product, or

(b)   replace the defective product with a new or remanufactured product of equal or greater value and cosmetic appearance, or

(c)   provide replacement components to resolve the issue, or

(d)   provide a refund of the full purchase price to you.

While we will always seek to assist you with your preferred remedy, we are not always able to accommodate your preferences.  Accordingly, we reserve the option to choose any one of the above remedies to address your warranty claims. 

In order to be eligible for one of our warranty remedies, you will be required to ship the defective product to us.  We are pleased to provide free round-trip shipping within the U.S. for approved warranty repairs, replacements or reimbursements.  As discussed below, we do not reimburse labor, installation, removal, diagnostic, or third-party service charges.

Our warranty policy is subject to a one-time replacement limit per customer.  In other words, once we have provided you with a replacement product under our warranty policy, our warranty will expire, and you will no longer be eligible to make any further warranty claims.  This one-time replacement limit applies to warranty claims made for any purpose, including shipping damage, and it applies to all subsequent purchases from Hamilton made by you (or on your behalf by one of our authorized installers).  This one-time replacement limit does not apply to our auto shop customers making warranty claims on behalf of different customers.  Likewise, this limitation does not apply to our any claims made through Route shipping insurance. 

4) Coverage Exclusions

Our warranty does not cover:

A) Defects in or Damage to Your Vehicle’s Original Parts (or to Products Not Sold by Hamilton) 

Working on cars, especially old cars, always involves risks.  While we always seek to provide helpful assistance to our customers in their installation of our parts in their vehicles, we cannot insure against damage to your car during the installation process.  Our warranty does not cover any damage to your vehicle (or any other products not sold by Hamilton) caused by or related to your installation of our products—including damage to your vehicle’s original parts removed during the installation process, damage to your vehicle’s electronic system or any other damage to your vehicle.  Likewise, our warranty does not cover damage done to your car by Hamilton’s authorized installers.  For more information on Hamilton’s policy with respect to our authorized installers, please see https://www.hamiltonmotorcompany.com/pages/support. 

See Section 6, below, for additional information regarding your vehicle. 

B) Repair, Installation or Other Third-Party Costs

We sell kits for our customers to install in their own vehicles at their own expense.  As a retailer of retrofit or replacement parts, we cannot afford to provide coverage or reimbursement for any third-party costs incurred by our customers, including during the installation, repair or warranty claim processes.  Accordingly, our warranty does not cover any fees or other costs paid to third-parties—for any reason.  Please do not pay any technicians or mechanics with the expectation of receiving reimbursement from us.  For more information on Hamilton’s policy with respect to fees paid to our Hamilton authorized installers, please see https://www.hamiltonmotorcompany.com/pages/support. 

C) Defects in our Products’ Design or Features

See Section 2, above, for more detail.

D) Shipping Damage 

Damage caused to our products during the shipping process is subject to our warranty policy only if such damage is reported within 48 hours after the product is delivered.  Please inspect your order as soon as it arrives and report any shipping damage immediately.  Unless reported within this period, we must presume that the damage took place after delivery.

E) Damage to Hamilton Products After Manufacturing and Fulfillment (Outside of Normal Use)

Our warranty is not an insurance policy, so it does not cover any damage to Hamilton’s products other than defects in the materials, workmanship or manufacturing of our products under normal use.  This means that we are not responsible under our warranty policy for any damage caused to our products after they are delivered.  

While we seek to assist our customers in the smooth and efficient installation of our products in their vehicles, our customers are responsible for the skillful and successful installation of our products in their vehicles.  Accordingly, inadvertent (or intentional) damage to our products during the installation process is not covered by our warranty policy.

Examples of these exclusions include:

·       loss or theft of our products, including through porch piracy;

·       damage from accidents, abuse, misuse, liquid ingress, fire, or natural disasters;

·       damage from wiring errors, short circuits, or use outside stated specifications;

·       use with incompatible vehicles or contrary to our documentation;

·       unauthorized or undirected modifications or repairs, including firmware changes, third-party ROMs, or altered harnesses;

·       commercial/institutional use beyond normal consumer use unless explicitly approved in writing; or

·       intentional damage to the device.

F) Minor Defects Not Meaningfully Affecting the Functionality of Our Products

Our products are retrofit or replacement parts for used vehicles.  Through installation or otherwise, these products may become subject to various minor or immaterial defects that do not meaningfully affect their functionality or usability.  Our warranty policy does not cover such defects.

Although these minor defects are not covered by our warranty policy, our customers may be rightfully concerned about such minor defects.  Accordingly, we encourage any disappointed customers to consider whether they would be eligible for a return under our separate Return Policy, available at https://www.hamiltonmotorcompany.com/pages/support.

G) Other Exclusions

We are not responsible under our warranty policy for:

·       data loss or restoration (settings, presets, personal data);

·       any customer items, including your vehicle’s factory components, inadvertently or intentionally sent to us in connection with warranty claims;

·       ongoing software or firmware support for our products; or

·       consumables and wear items (e.g., adhesives, clips) used by our products.

5) What’s Covered (Examples) 

Examples of defects covered by our warranty policy include:

·       internal electronics or circuit board failures;

·       display failures (e.g., backlight failure, dead pixels above standard thresholds);

·       harnesses or cables with manufacturing defects; and

·       certain other device failures or defects.

6) Factory Equipment Responsibility Disclaimer

Hamilton products are designed to integrate with existing factory equipment in your vehicle in a non-destructive manner. Based on our engineering, testing, and experience, we do not believe our systems are capable of damaging OEM or factory-installed equipment when installed as directed. 

However, because our products are retrofit or replacement parts for used vehicles (including vehicles outside their original manufacturer’s warranty period), Hamilton cannot and does not assume responsibility for your vehicle, including:

·       any defects, failures, or malfunctions of your vehicle or its factory-installed or OEM equipment that arise after Hamilton product installation;

·       any pre-existing conditions, wear-and-tear issues, or latent defects in the vehicle’s systems;

·       any factory equipment failures, including related to the installation of a Hamilton product.

Note:  It is possible to have latent defects in your original equipment and not be aware of it.  Signs of defects include factory devices that power cycle, factory devices that do not play audio, and factory devices that may intermittently restart.  If your factory equipment has any of these defects, we do not recommend trying to install any upgrade systems to your vehicle, as they cannot resolve factory defects. 

By purchasing or installing a Hamilton product, you acknowledge and agree that your vehicle’s factory systems may be subject to failure or damage over time, and that Hamilton is not responsible for diagnosing, repairing, or replacing factory or OEM components that fail or are damaged in your vehicle (including during or after the installation of our products).

7) Transferability

This warranty applies only to the original purchaser (whether directly from Hamilton or through a Hamilton authorized installer) and is non-transferable.  See Section 1 for more detail.

8) How to Request Service (RMA Process)

·       Online: click “Warranty Claim” on our website and complete the form.

2.                Prepare your order number, serial/SKU (if applicable), vehicle info, problem description, and any helpful photos or videos.

3.                Return your defective product to us.  If a return is authorized, we’ll issue an RMA number and pre-paid shipping label.  Note: Items sent to us without an RMA number may be refused or delayed.

9) Out-of-Warranty Support

If your warranty has expired or is inapplicable, we still want to do our best to help you.  Please contact us through “Warranty Claim”, and we would be happy to discuss discounted replacement parts and support options. 

10) International Warranty Returns & Shipping

We are unable to offer free shipping in connection with warranty claims made by any customers located outside of the United States.  For any such warranty claims by our international customers (or other filers of warranty claims abroad), such customers are solely responsible for any costs associated with facilitating the warranty claim, including:

·       any duties or taxes imposed on our products, including any replacement or repair parts;

·       shipping costs to Hamilton’s designated service center;

·       customs duties, taxes, or import/export fees; and

·       return shipping costs from Hamilton back to the customer’s location outside the United States.

Hamilton may, in our sole discretion, offer certain discounted shipping options to international customers or customers with foreign warranty claims, but such discounts are offered on a voluntary basis and do not create any ongoing obligations. 

11) Loss of Use & Vehicle Downtime Disclaimer 

Hamilton is not responsible for any loss of use, inconvenience, rental expenses, or vehicle downtime while a product is being diagnosed, repaired, or replaced under warranty, including for products that are brand new or fail during initial use. 

Hamilton may, in our sole discretion, offer expedited shipping or alternative accommodations to reduce inconvenience, but such service is offered on a voluntary basis and does not create any ongoing obligations. 

12) Limitations of Liability

To the maximum extent permitted by law, Hamilton shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to labor costs, installation/removal charges, loss of use, data loss, downtime, or lost profits, whether arising in contract, tort, or otherwise.  Some states do not allow exclusions of incidental or consequential damages, so this limitation would not apply to you to the extent impermissible under relevant law. 

Our total liability under this warranty shall not exceed the original purchase price of the product.  (In other words, you agree that the refund of the original purchase price by Hamilton, in our sole discretion, would be an acceptable remedy for any damages.)

13) Governing Law & Venue

This warranty will be construed and enforced exclusively pursuant to the laws of the State of North Carolina, without regard to its conflict of laws provisions.  You agree that the venue of any action to enforce the provisions of this warranty, or any other document in connection with this warranty, will be in Wake County, North Carolina (to the extent not subject to arbitration, as set forth in Section 15).  You and Hamilton agree not to contest the choice of law and venue provisions in this paragraph. 

14) Updates

We may update this warranty periodically.  The version in effect as of the date of your purchase applies to your order.

15) Arbitration Agreement and Class Action Waiver

By purchasing or using this product, you and Hamilton agree that any dispute, claim, or controversy arising out of or relating to this product or this warranty shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, and not in court.  You and Hamilton expressly waive any right to bring or participate in a class action, class arbitration, or any other representative action.

The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

This arbitration agreement is governed by the Federal Arbitration Act (FAA) and shall survive termination or expiration of this warranty.

Opt-Out Option:  You may opt out of this arbitration agreement by sending written notice to Hamilton within 30 days of your product purchase date.  Opting out will not affect your coverage under this warranty.
